Terms of service

These terms govern use of the Alignd website, the browser demo, a four-week pilot, and any ongoing subscription. They are between you (the customer organisation) and Vasco Machado de Oliveira, operating Alignd as a sole trader ("Alignd", "we").

1. What we provide

Alignd is a shared alignment-scoring service for a project run between a client and a delivery partner. We provide the application, the weekly pulse, the scoring model, the shared dashboard and the record of closed weeks. We do not provide consulting, project management or assurance services, and the score is decision support, not advice.

2. Pilots

A pilot covers one engagement, both sides, for four weeks: setup, four weekly pulses and a closing read-out. Pilots are free, and either party may end a pilot at any time, in writing, with no fee. At the end of the pilot you choose whether to continue; nothing renews automatically.

3. Accounts and access

Each participant needs their own account and must keep their credentials secure. Access is scoped to the engagements you are a member of. You are responsible for who you invite to an engagement and for removing people who leave the project. Tell us promptly at hello@tryalignd.com if you believe an account has been compromised.

4. Acceptable use

Don't use Alignd to store special-category personal data, to assess or performance-manage named individuals, to probe or disrupt the service, to resell access, or to break the law. Individual pulse answers are shown only in aggregate by design, and attempting to de-anonymise them — including by running an engagement with too few participants to protect anonymity — is a breach of these terms.

5. Your data

You own your engagement data. We process it to run the service, in line with our privacy policy and the data-processing agreement issued at pilot start. You can export or request deletion of an engagement at any time; deletion completes within 30 days. We do not use your engagement data to train models or share it with your counterparty's other engagements.

6. Both-sided nature of the service

Alignd requires both sides of an engagement to participate. If one side stops responding, weeks are still closed and marked one-sided. Neither side can edit, delete or reinterpret a closed week — that immutability is a feature, and you agree not to ask us to override it.

7. Availability and support

We aim for high availability but the service is provided without an uptime guarantee during pilots. Planned maintenance is announced by email where it is likely to affect a pulse window. Support is by email, one working day response, Monday to Friday.

8. Fees

Pilots are free. After a pilot, pricing is per engagement as published at tryalignd.com/pricing — currently per engagement per month for Standard, or an annual volume-banded license for Portfolio — invoiced in advance and stated in your order. Fees exclude VAT. You can cancel a Standard subscription with 30 days' notice, effective at the end of the current billing period.

9. Liability

To the maximum extent allowed by law, our total liability under these terms is limited to the fees you paid in the twelve months before the claim. We are not liable for indirect or consequential loss, lost profit, or business decisions taken on the basis of a score. Nothing limits liability for death, personal injury, fraud, or anything else that cannot lawfully be limited.

10. Confidentiality

Each party keeps the other's non-public information confidential and uses it only to run the service or the engagement. We may describe an engagement anonymously as a case study only with your written consent.

11. Changes and termination

We may update these terms; material changes are notified by email at least 30 days in advance for active customers. We may suspend access for non-payment or a serious breach of clause 4, after telling you. On termination we provide an export on request and then delete your data on the retention schedule in the privacy policy.

12. Governing law

These terms are governed by the laws of Portugal, with the courts of Portugal having exclusive jurisdiction.
